Louisiana Staged-Crash Scheme: Attorney Danny Keating Sentenced to 32 Months in Prison

The former lawyer must pay more than $657,000 in restitution after admitting his role in Operation Sideswipe. Despite cooperating with federal investigators and helping secure convictions against fellow attorneys, he received a longer prison term than prosecutors had requested.

Louisiana Staged-Crash Scheme: Attorney Danny Keating Sentenced to 32 Months in Prison

Danny Keating, a former Louisiana attorney implicated in a sprawling staged-accident fraud scheme targeting tractor-trailers in the New Orleans area, has been sentenced to 32 months in federal prison. The sentence, handed down Thursday, also requires him to pay $657,405.34 in restitution, followed by three years of supervised release.

Keating was among the central figures in what the U.S. Attorney’s Office for the Eastern District of Louisiana called “Operation Sideswipe.” The scheme involved deliberately causing vehicle collisions, often involving tractor-trailers, to generate fraudulent personal injury claims and secure insurance payouts.

Although Keating cooperated with federal investigators after pleading guilty in June 2021, the court imposed a prison term exceeding the two years sought by prosecutors. His sentence nevertheless falls below the federal sentencing guidelines range of 57 to 60 months, according to reporting by NOLA.com, the online successor to The Times-Picayune.

Cooperation with prosecutors did not prevent a prison sentence

Keating is the only attorney implicated in the case who has pleaded guilty. Since admitting his role in the scheme, he has assisted federal prosecutors and served as a key witness in the successful prosecution of fellow attorneys Vanessa Motta and Jason Giles.

Both were convicted in March for their involvement in the staged-accident operation. Their sentencing hearings remain pending after previously scheduled dates were postponed. The parties continue to address various motions, and no new sentencing dates have been set.

Keating’s sentencing had itself been postponed repeatedly between his guilty plea and Thursday’s hearing.

According to NOLA.com, his attorney, Brian Capitelli, asked U.S. District Court Judge Nanette Brown to impose probation rather than imprisonment. The request cited Keating’s cooperation with investigators and his poor health.

Prosecutors also acknowledged the significance of his assistance. Assistant U.S. Attorney Brian Klebba argued for a two-year sentence, emphasizing that Keating had accepted responsibility, surrendered his law license and provided information about the crimes.

“When faced with a choice, Mr. Keating chose to admit to his misdeeds, forfeit his law license and tell the truth about the crimes that he and others committed,” Klebba told the judge, according to NOLA.com.

Keating must report to prison by January 11, 2027.

A wider criminal investigation involving a murder case

The staged-collision investigation has also intersected with a separate prosecution over the killing of Cornelius Garrison, another participant who agreed to cooperate with federal authorities after pleading guilty in 2020.

Garrison was shot and killed at his home shortly after agreeing to assist investigators. Keating did not testify in the subsequent murder trial involving several defendants accused in connection with Garrison’s death.

That case produced a mixed outcome. The jury failed to reach a unanimous verdict on the principal murder charges, resulting in a hung jury, and no retrial has been scheduled. Other convictions were secured in the proceedings.

The developments have underscored the broader criminal investigations surrounding the staged-accident network, extending beyond fraudulent insurance claims to allegations of violence and the killing of a cooperating witness.

Keating admitted paying for 31 tractor-trailer crashes

In a prepared statement announcing the sentence, David Courcelle, the U.S. attorney for the Eastern District of Louisiana, said Keating admitted in his 2021 guilty plea to paying Damian Lebeaud, another ringleader, in connection with 31 tractor-trailer crashes.

At the same time, Keating represented 77 plaintiffs involved in the staged collisions, creating a direct financial interest in claims arising from the deliberately engineered accidents.

According to the U.S. Attorney’s Office, settlements and other payouts connected to the collisions totaled approximately $1.5 million for plaintiffs represented by Keating. He retained around $358,000 of that amount.

Lebeaud also cooperated with federal prosecutors. Like Keating, he has experienced multiple sentencing delays, but his sentencing is now scheduled for December 3.

Defense seeks medical placement in federal custody

Following Thursday’s sentencing, Keating’s attorneys submitted a request on Friday asking the U.S. Bureau of Prisons to assign him to the minimum-security satellite camp at the Federal Correctional Institution in Beaumont Low, Texas.

The court filing cites significant medical concerns, including common variable immunodeficiency (CVID), a condition affecting the immune system, and the presence of two spinal cord stimulators.

His attorneys argued that these conditions, together with his medication requirements, warrant placement in a federal medical facility capable of addressing his needs.

“Due to CVID and the spinal cord stimulators and his medication requirements, it is requested that he be designated to a Federal Medical Facility,” the filing stated.

The attorneys said the Beaumont facility has the capacity to treat the conditions identified in the request.

The Bureau of Prisons’ final placement decision will determine where Keating serves his sentence. His conviction and prison term mark another major development in the federal prosecution of the Louisiana staged-accident scheme, which generated millions of dollars in claims and implicated multiple legal professionals.
