Police Investigate Alleged Little Debbie Delivery Fraud Involving Fake Invoices and Store Signatures

A West Virginia distributor faces 15 criminal charges in Pennsylvania after investigators alleged that forged delivery records generated payments for snack shipments that never occurred.

A West Virginia distributor is facing 15 criminal charges in Pennsylvania over an alleged fraud scheme involving Little Debbie snack deliveries that investigators say never took place.

The City of Washington Police Department in Pennsylvania has charged James Powell of Valley Grove, West Virginia, in connection with the case. Authorities are seeking $17,167.97 in restitution, according to a police department release provided directly to FreightWaves.

Powell remains in custody in West Virginia while he undergoes extradition proceedings to Washington County, Pennsylvania.

According to investigators, Powell allegedly created fraudulent delivery invoices while working as a distributor. The documents indicated that Little Debbie products had been delivered to Pennsylvania retail stores even though the shipments never occurred.

Police also allege that Powell used forged employee signatures to falsely confirm that merchandise had been received. The fraudulent invoices were then submitted through the manufacturer’s central billing system.

The investigation identified retail locations operated by Shop N’ Save, Giant Eagle and Walmart in Washington County, Pennsylvania.

Stewart Snacks LLC, an independent distributor of Little Debbie snack products, reported the suspected fraud. Authorities allege that the company reimbursed the affected retailers and the manufacturer for the resulting losses. Powell allegedly received commission payments for deliveries that never took place.

Investigation began in Ohio

The case began after Stewart Snacks reported suspected fraudulent business records and missing products. The company initially contacted the Jefferson County Sheriff’s Office in Ohio.

Investigators subsequently determined that alleged offenses had occurred in Washington and South Strabane Township, both in Pennsylvania. The case was then referred to the City of Washington Police Department.

Washington police conducted an extensive investigation after receiving the referral. Detectives reviewed delivery invoices associated with several Pennsylvania retail locations and identified records that allegedly documented merchandise customers never received.

Investigators also found signatures they believe were falsely used to confirm the transactions.

Before filing charges, the police department consulted with the Washington County District Attorney’s Office.

Powell faces 15 charges

Powell faces three second-degree felony counts of forgery.

Prosecutors also filed two third-degree felony counts each for theft by deception and unlawful taking. Another third-degree felony charge alleges deceptive or fraudulent business practices.

The remaining seven charges are first-degree misdemeanors. Three involve tampering with records or identification, while separate counts accuse Powell of theft by deception and unlawful taking. Two additional misdemeanor charges involve deceptive or fraudulent business practices.

Authorities later arrested Powell in West Virginia under a warrant connected with the Pennsylvania investigation.

He is currently undergoing extradition proceedings, which would return him from West Virginia to Washington County, Pennsylvania, where he will face the filed charges.

All of the charges remain allegations. Powell is presumed innocent unless and until he is proven guilty in court.

Why it matters The case illustrates how false documentation can give the impression of a legitimate delivery when in fact no delivery took place in normal business and billing systems.

By implementing strong verification processes companies can identify inconsistencies before fraudulent invoices lead to payments, reimbursements or commission payouts. Therefore for distributors, retailers and manufacturers verifying deliveries and signatures can be a key way to protect supply chain transactions from fraud.
