In the United States, a bill in Tennessee is already causing a stir in the transportation sector. The text aims to significantly strengthen the sanctions surrounding the “illegal” operation of commercial vehicles. Specifically, the project provides for criminal offenses for the person concerned, but also for any entity that “knowingly” allowed the operation of the vehicle under these conditions.

The system goes further by incorporating a logic of automatic civil liability in case of an accident: certain categories of actors could be exposed to heavy consequences, with high damage and penalty mechanisms. The text also includes procedural obligations, notably provisions for notification to federal authorities in certain cases of arrest related to these offenses.

Beyond the political debate, the industry mainly takes note of the signal: if the law passes, it could influence how companies frame their recruitment, documentation compliance, and outsourcing practices. In an already strained market, this type of measure can quickly translate into stricter internal audits, increased legal risks, and stricter requirements from clients.
