OLT approves Nelson Aggregate’s controversial Burlington Quarry expansion

The Ontario Land Tribunal has approved the proposed 50.5-hectare expansion, clearing the way for a new aggregate licence while Burlington officials continue to assess the decision.

The Ontario Land Tribunal (OLT) has approved Nelson Aggregate’s proposed expansion of the Burlington Quarry, bringing the long-running dispute over the project closer to implementation.

The decision allows the company to move toward obtaining the required aggregate licence, subject to conditions and additional revisions to its site plans and adaptive management plan.

The expansion would add approximately 50.5 hectares to the existing quarry operation.

Tribunal finds project meets planning requirements

Following an extensive hearing involving thousands of pages of technical evidence and expert testimony, the OLT concluded that the expansion is consistent with provincial planning policies, represents good planning and serves the public interest.

The tribunal also determined that Nelson Aggregate had adequately addressed concerns surrounding groundwater, surface water, natural heritage, dust, blasting and fly-rock through proposed monitoring measures, site plans and its adaptive management programme.

The Ministry of Natural Resources and the Ministry of the Environment, Conservation and Parks reported no outstanding requirements. Conservation Halton also resolved its concerns and withdrew from the hearing, while the Niagara Escarpment Commission reached settlement terms supporting the required approvals.

Burlington voices disappointment

The City of Burlington said it was disappointed with the decision and reiterated its opposition to the expansion.

City officials cited concerns about potential effects on the natural environment, wildlife, groundwater, the rural community and the quality of life of nearby residents.

The city also acknowledged the efforts of residents, environmental organizations and community advocates who have spent years opposing the project and seeking to protect the Mount Nemo Plateau and Niagara Escarpment.

Burlington said it is reviewing the tribunal’s decision with legal counsel.

Future parkland planned

Nelson Aggregate president Quinn Moyer welcomed the ruling, saying the decision will allow the company to continue supplying aggregate to the growing western Greater Toronto and Hamilton Area while pursuing long-term environmental and community benefits.

A major element of the plan is the eventual transfer of the Burlington Quarry and expansion lands to Conservation Halton after extraction and rehabilitation are completed.

The transfer is expected to create nearly 1,000 acres of publicly accessible parkland and open space.

Before the final licence can be issued, Nelson must complete revisions required under the tribunal’s interim order.

The company said it remains open to working with the City of Burlington, residents and community groups during the implementation phase.
