Trump’s Red-Dyed Diesel Tax Relief Order Leaves Key Implementation Questions Unresolved

The executive order directs Treasury Secretary Scott Bessent to coordinate with states and industry stakeholders, but conflicting state regulations and distribution constraints could limit the benefits for trucking companies.

President Donald Trump’s executive order on temporary tax relief for red-dyed diesel has been formally published in the Federal Register, but it leaves a central obstacle largely unresolved: the lack of alignment between federal tax measures and state regulations governing the fuel’s use on public roads.

Published on Friday, the four-page order follows what it describes as historic efforts to ensure fuel affordability for Americans. However, the administration argues that additional temporary relief is necessary.

The order instructs Treasury Secretary Scott Bessent to use his authority to defer certain diesel fuel tax payment obligations. He is also tasked with examining whether penalties can be waived for using red-dyed diesel in on-highway applications, where its use may otherwise be prohibited.

Red-dyed diesel is conventional diesel fuel blended with a red dye that changes its appearance without affecting its performance. The dye identifies fuel intended for specific uses, particularly in agriculture, that qualify for an exemption from federal excise taxes.

The standard federal diesel excise tax is 24.3 cents per gallon, in addition to a 0.1-cent-per-gallon fee supporting the Leaking Underground Storage Tank Trust Fund.

Tax relief could extend through December 31

If approved after a five-day review, the deferral would be applied to fuel tax liabilities from October 5 through December 31.

The administration is also looking at a longer-term fix that would eliminate the need to repay the deferred amounts, which could turn the temporary relief into a permanent tax benefit for the rest of the year.

The executive order states, “The Secretary shall consider options, including legislation, to eliminate the obligation to pay the amounts deferred pursuant to the Secretary’s exercise of authority described in section 2 of this order.”

But state-level restrictions still complicate the measure’s practical implementation. Some states prohibit red-dyed diesel on their roads, leading to a mismatch between state and federal rules.

Another challenge is the existing distribution network of fuel. Wholesale and retail distributors typically carry clear diesel fuel which is subject to federal excise taxes. Red-dyed diesel requires dedicated tanks and pipelines, which are not normally available outside certain supply arrangements, making it difficult to ramp up distribution quickly.

To overcome these barriers, the order instructs Bessent to work with state governments, relevant industry leaders, and labor organizations. The goal is to allow safe and timely coordination between federal authorities and the range of stakeholders involved in executing the policy.

Several states have already eased restrictions

In recent weeks, several states have taken steps to ease the use of red-dyed diesel on their highways. Texas, Indiana, Illinois, Nebraska, North Dakota, Ohio, Oklahoma, North Carolina, Arkansas and Alabama have all made some concession to their existing rules, helping the promotion of access to the lower-cost fuel.

However, differences in state policies could create major administrative problems for truck operators.

Companies that travel across state lines can leave jurisdictions that provide relief and enter states where no waiver applies. These trips could also create additional tax-accounting burdens for carriers to differentiate between eligible and ineligible fuel uses, and further complicate compliance.

Some operators might find the hassle of administration is not worth the tax break.

Fuel management company Breakthrough Fuel also questioned the measure’s impact on the real world. The company said the tax changes would have a “low” effect at the retail level, but also highlighted the limitations of the proposed approach.

“Road lanes rarely carry dyed fuel, interstate routes cross non-relief states and clear diesel prices are unaffected by the order,” the company said in its assessment.

These factors suggest that the relief may not materially affect trucking costs, particularly for carriers operating across jurisdictions with non-uniform exemptions.

Treasury tasked with expanding agricultural fuel distribution

In addition to coordinating regulatory changes, the executive order also seeks to improve availability of red-dyed diesel in areas with especially high demand.

The Secretary of the Treasury shall coordinate with agricultural cooperatives, rural fuel distributors, farm supply organizations, and such other agricultural stakeholders as are identified by the Secretary of Agriculture.

The objective is to secure adequate supplies of dyed diesel to meet the needs of agricultural users in areas of high demand, thus supporting their access to the fuel for activities historically benefiting from its tax exempt status.

While the order provides a framework for temporary tax relief and intergovernmental cooperation, differences in state regulations, limited distribution infrastructure, and the administrative difficulties associated with interstate trucking continue to be significant barriers to broader implementation.
